ELIZONDO FACING TWO MORE CHARGES, BREACH OF EMS INFO

News reports indicate that former Brownsville Fire Chief Carlos Elizondo has been slapped with two more charges by the Cameron County District Attorney, this time having to do with the breach of EMS computers security and gaining sensitive information on on fatal accidents.

Noticias Nueve reported that ELizondo accessed the EMS computers and retrieved information when he was not on duty.

This comes on the heels of a visiting judge's denial of a request for a hearing to challenge the search warrant that resulted in his arrest on theft charges.

In late December, the Brownsville Herald reported that his attorney Eddie Lucio filed a writ of habeas corpus challenging whether “good ground” existed for the issuance of a search warrant targeting Elizondo’s home. The court motion alleges that the investigator who prepared the warrant did not provide sufficient facts to establish probable cause and that 404th state District Judge Elia Cornejo-Lopez, who signed the warrant, was not neutral because of her relationship with the Brownsville Independent School District Board of Trustees.

Elizondo is a member of that board and Cornejo-Lopez, in her capacity as a parent, filed a federal lawsuit against BISD over how grievances she filed with the district were handled by school administrators and trustees.

Visiting Judge Martin Chiuminatto ruled that since a grand jury has already handed down indictments against Elizondo, his right to an examining trial regarding the search warrant has been extinguished.


In early April, Cornejo-Lopez recused herself from the proceedings, explaining that regardless of the outcome of the criminal proceedings, Elizondo should feel that he had a fair day in court.
